NOTIFICATION

G.O. (P) No. 30/2002/P&ARD. Dated, Thiruvananthapuram. 28th May 2002.

S.R.O.No. 464/2002. In exercise of the powers conferred by sub-section (1) of Section 2 of the Kerala Public Services Act, 1968 (19 of 1968), read with Section 3 thereof, the Government of Kerala hereby make the following rules further to amend the Kerala Civil Services (Classification, Control and Appeal) Rules, 1960 namely:

RULES

  1. Short title and Commencement- (1) These rules may be called the Kerala Civil Services (Classification, Control and Appeal) Amendment Rules, 2002.

(2) They shall come into force at one.

2.Amendment of the Rules- In Kerala Civil Service (Classification, Control and Appeal) Rules, 1960, after note (2) below clause (iii) of sub rule (1) of Rule 11 (in part V) the following note shall be inserted namely:-

(2A) The minimum period of permanent barring of increment shall not be less than one year and the maximum period shall not be for more than three years. Permanent barring of increment shall mean withholding of increment with cumulative effect i.e., it shall have the effect of postponing future increments.

Explanatory Note

(This is not form part of the notification, but is intended to indicate its general purport.)

In the Kerala Civil Services (Classification, Control and Appeal) Rules, 1960the minimum and maximum period for permanent withholding of increments has not been specified. In memorandum number 46162 /SD4/65/PD dated 5-5-1965, Government had specified that non-mention of a maximum and minimum period for permanent withholding of increment in the Rules is lacuna needing rectification. Hence it is necessary to indicate the minimum and maximum period for which the penalty of permanent withholding of increment is to be in force.

This notification is intended to achieve the above object.
